Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Inflowence. Violations of this policy may result in immediate suspension or termination of your account without refund.

1. Purpose

This AUP exists to:

  • Protect Inflowence's infrastructure and reputation
  • Ensure compliance with third-party service providers (GoHighLevel, AWS, Meta)
  • Maintain the quality and deliverability of our services
  • Prevent abuse that affects all users

2. Prohibited Activities

2.1 Spam and Unsolicited Communications

You may not:

  • Send unsolicited "cold" messages via SMS, email, or social media without proper consent
  • Purchase or use scraped contact lists
  • Send messages to individuals who have opted out
  • Fail to honor "STOP," "UNSUBSCRIBE," or similar opt-out requests
  • Misrepresent your identity or the source of messages

2.2 Illegal Content and Activities

You may not use Inflowence to:

  • Engage in or promote illegal activities
  • Distribute malware, viruses, or harmful code
  • Conduct phishing or social engineering attacks
  • Violate intellectual property rights
  • Facilitate fraud or financial crimes
  • Distribute illegal or obscene content

2.3 High-Risk Industries

The following industries are prohibited or restricted on certain communication channels:

Prohibited on All Channels:

  • Adult content or services
  • Illegal drugs or substances
  • Weapons and explosives
  • Gambling (where prohibited by law)

Restricted on Social Media & Messaging:

  • CBD and cannabis products
  • Payday loans and high-interest lending
  • Cryptocurrencies and NFTs (subject to platform policies)
  • Multi-level marketing (MLM) schemes

2.4 Platform Policy Violations

You must comply with all terms and policies of:

  • GoHighLevel - You may not engage in activities that violate GHL's Acceptable Use Policy
  • AWS - You must maintain acceptable bounce rates (<5%) and complaint rates (<0.1%)
  • Meta - You must comply with Meta's Business Messaging Policy and Community Standards
  • Carrier Requirements - You must comply with 10DLC and TCPA regulations for SMS

2.5 System Abuse

You may not:

  • Attempt to bypass security measures or access controls
  • Conduct denial of service attacks
  • Probe, scan, or test vulnerabilities in our systems
  • Use automation tools to access the service in unauthorized ways
  • Resell or redistribute the service without authorization
  • Create multiple accounts to circumvent restrictions

2.6 Data Misuse

You may not:

  • Collect or harvest user data from platforms without authorization
  • Share, sell, or distribute customer data to third parties
  • Use data for purposes other than those disclosed to customers
  • Violate any individual's privacy rights
  • Store or process sensitive data (SSN, financial data) without proper security measures

3. Communication Standards

3.1 SMS and Voice

  • All SMS must include opt-out instructions (e.g., "Reply STOP to unsubscribe")
  • Messages must identify your business clearly
  • You must have documented consent before first contact
  • Voice calls must include proper AI disclosure (see Voice & AI Disclosure)
  • Recording disclosures must be provided as required by law

3.2 Email

  • All emails must include a valid physical address
  • All emails must include a functional unsubscribe link
  • You must honor unsubscribe requests within 10 business days
  • Subject lines must accurately reflect email content
  • "From" fields must not be deceptive

3.3 Social Media DMs

  • You must comply with the 24-hour message window on WhatsApp
  • You must not send unsolicited promotional content
  • You must respect platform-specific message limits
  • You must not impersonate others or create fake accounts

4. Quality Thresholds

To protect our infrastructure and sender reputation, you must maintain:

4.1 Email Metrics

  • Bounce Rate: Below 5%
  • Complaint Rate: Below 0.1%
  • Spam Trap Hits: Zero tolerance

4.2 SMS Metrics

  • Carrier Filtering: Minimal SPAM flags
  • Opt-out Rate: Below industry standards
  • Response Rate: Positive engagement indicators

Exceeding these thresholds may result in immediate suspension to protect our service.

5. Consequences of Violations

5.1 Warning

For minor or first-time violations, we may issue a warning and require corrective action.

5.2 Suspension

For serious or repeated violations, we may suspend your account immediately. During suspension:

  • You will not have access to the service
  • Subscription fees continue to accrue
  • Your data will be retained per our data retention policy

5.3 Termination

For severe violations or failure to correct issues after suspension, we will terminate your account:

  • Access will be permanently revoked
  • No refunds will be issued for prepaid services
  • You may be banned from creating future accounts
  • We may report illegal activity to authorities

5.4 Legal Action

We reserve the right to pursue legal action for:

  • Violations that cause financial harm to Inflowence
  • Violations that harm our reputation or relationships with partners
  • Illegal activities conducted through our service

If you become aware of violations of this AUP:

7. Third-Party Complaints

If we receive complaints from:

  • Recipients of your messages
  • Third-party platforms (Meta, AWS, carriers)
  • Regulatory authorities
  • Other users

We will investigate and may take immediate action to protect our service and other users.

8. GoHighLevel Compliance

Inflowence operates as a GoHighLevel agency partner. You acknowledge that:

  • Your actions may affect our agency account standing
  • We must enforce standards at least as strict as GHL's own AUP
  • GHL policy violations may result in immediate termination
  • We may share information with GHL for compliance purposes

9. AWS Compliance

Inflowence uses AWS for email delivery (SES). You acknowledge that:

  • AWS has strict sending policies we must enforce
  • High bounce or complaint rates affect all users
  • AWS may suspend services for violations
  • We will terminate accounts that threaten our AWS standing

10. Meta Platform Compliance

For WhatsApp, Facebook, and Instagram integrations:

  • You must comply with Meta's Business Terms
  • Page or account bans by Meta are not grounds for refund
  • We are not liable for Meta policy enforcement
  • You must maintain proper opt-ins for all contacts

11. Updates to This Policy

We may update this AUP at any time to:

  • Reflect changes in third-party requirements
  • Address new forms of abuse
  • Improve clarity and enforcement

Material changes will be communicated via email.

12. No Guarantee of Service

Compliance with this AUP does not guarantee:

  • Uninterrupted service
  • Specific delivery rates
  • Protection from third-party enforcement actions

13. Your Obligations

By using Inflowence, you agree to:

  • Read and understand this AUP
  • Monitor your account for compliance
  • Respond promptly to compliance notices
  • Maintain proper documentation of consent
  • Train your team on these requirements
